This policy describes how Windconsul Tech LLC handles personal information in connection with its SMS messaging programs. Windconsul Tech LLC is the sender of all messages described in this policy and is the sole entity responsible for the programs described below.
Windconsul Tech LLC operates under the Wind Consulting brand and develops and manages software platforms for client organizations in the United States.
2. Corporate Structure and Scope of This Policy
The Wind Consulting brand is used by two separate legal entities:
Windconsul Tech LLC, registered in the State of Georgia, United States. This entity operates the SMS messaging programs described in this policy.
Wind Consulting S.A. de C.V., a company incorporated under the laws of Mexico, which serves clients in the Mexican market.
This policy applies exclusively to the SMS messaging programs operated by Windconsul Tech LLC. Wind Consulting S.A. de C.V. is a separate legal entity, is not a party to these messaging programs, and its own privacy notice does not govern them.
Mobile information collected under this policy is not shared with Wind Consulting S.A. de C.V. for marketing or promotional purposes.
3. Our SMS Program
Windconsul Tech LLC operates technical support messaging programs for the software platforms it develops and manages. Messages are sent to designated technical contacts at client organizations and to registered platform users who have given express consent.
Messages are limited to the following:
Support ticket status updates
System incident notifications
Scheduled maintenance windows affecting the recipient's environment
Two-way conversations in which the recipient replies and a Windconsul support engineer responds through the same channel
No promotional, marketing or advertising content is sent through these programs.
Windconsul Tech LLC does not send messages on behalf of other companies through these programs.
4. Consent
Recipients opt in by affirmatively selecting SMS notifications during registration in the applicable platform. No option is pre-selected, and registration does not require accepting SMS messages. Consent is optional and may be withdrawn at any time.
Where a client organization designates technical contacts under a service agreement, the first message sent to a newly designated contact identifies the sender, states the purpose of the program and explains how to opt out.
5. Message Frequency, Rates and Opt-Ou
Message frequency varies and depends on the activity of the recipient's environment.
Message and data rates may apply.
Recipients may unsubscribe at any time by replying STOP or BAJA. Recipients may request assistance by replying HELP or AYUDA, or by contacting soporte@windconsul.com.
6. Information We Collect
For these programs, Windconsul Tech LLC collects the recipient's mobile telephone number, the name and organization associated with the contact, the record of consent, message delivery status, and the content of messages exchanged through the channel.
7. How We Share Mobile Information
Mobile information and SMS messaging consent will not be shared with third parties or affiliates for marketing or promotional purposes.
Phone numbers collected for these programs are shared only with the telephony provider required to deliver the messages. That provider processes the information solely to deliver messages on our instructions and may not use it for its own purposes.
No mobile information is sold, rented or traded. No mobile information is shared with advertising networks, data brokers or analytics providers. Cookies, advertising pixels and website tracking technologies are not applied to mobile numbers collected for SMS.
Information may be disclosed where required by law, in response to a valid order from a competent authority, to prevent fraud, or to protect rights and safety.
8. Retention
Mobile numbers and consent records are retained for as long as the recipient remains an active contact and afterwards only as long as necessary to demonstrate compliance with applicable messaging regulations. Opt-out records are retained indefinitely so that a recipient who has unsubscribed is not contacted again.
9. Security
Windconsul Tech LLC applies role-based access controls, encryption in transit, and activity logging to protect this information.
10. Your Rights
Depending on the applicable law, recipients may request access to the information held about them, request correction or deletion, and object to certain processing. Requests may be sent to contacto@windconsul.com. Windconsul Tech LLC may request reasonable information to verify identity before acting on a request.
11. Changes to This Policy
This policy may be updated when the programs, providers or legal requirements change. The current version is published at this address with the date of its last update.
